West Bridgewater Zoning Board of Appeals
Meeting Minutes
December 22, 2009
Board members present: Chairman William Lucini, James Henderson, Gary Eliasson, Armen Amerigian, Carolyn Ameno, Thomas Snell, and Fred Hartblay.
A Public Hearing was held at 7:00 p.m. on the application of 24 Sunset Avenue Acquisition, LLC, c/o Pierce & Mandell, P.C., 11 Beacon St., Boston, MA. The applicant is seeking a Special Permit to convert an existing, vacant, non-conforming structure, formerly utilized as a commercial candy factory, into a two family residential dwelling. The property is located in the General Residence and Farming District as shown on Map 24, Lot 70. The applicable sections of the zoning bylaw are Section 4.4 (3) Table of Uses, and Section 7.5 Special Permit. The Public Hearing was continued to Tuesday, January 12, 2010, at 7:00 p.m. at which time a plot plan of the property will be presented for the board’s review.
A Public Hearing was held at 7:25 p.m. on the application of Eugene Pacella and Anthony Pacella. The applicant is appealing the decision of the Building Inspector to issue a Cease and Desist Order for an asphalt recycling machine for asphalt and asphalt reclamation being used on the property at Universal Construction, 373 Crescent Street, West Bridgewater, MA. The property is located in the General Residence and Farming District as shown on Map 37, Lot 002. The applicable sections of the zoning bylaw are Section 7.1 and Section 7.3.2.1.(a).
Following the Public Hearing, the Board voted to overturn the decision of the Building Inspector to issue a Cease and Desist Order, dated October 13, 2009, to Mr. Eugene Pacella and Mr. Anthony Pacella of Universal Construction, 373 Crescent Street, West Bridgewater, MA, for the operation of an Asphalt Recycling Machine, used for Asphalt and Asphalt Reclamation. The Board feels the addition of this machine does not constitute a change of use for this property.
Vote was taken as follows: William Lucini, James Henderson, Gary Eliasson, and Carolyn Ameno voting in favor of the motion. Mr. Amerigian abstained. The motion carried.
