Meeting Minutes
April 6, 2010

Board members present:  Chairman William Lucini, James Henderson, Armen Amerigian, Thomas Snell, and Fred Hartblay.
A Public Hearing Continuance was held at 7:00 p.m. on the application of Michele Tibbetts, 78 Maolis Avenue, West Bridgewater, MA.  The applicant is seeking a Special Permit for the designation of an existing dwelling as a two family dwelling.  The applicant is also seeking a Variance to allow the existing lot frontage of 110 feet, instead of the required 200 feet for a two family dwelling, and allow the existing lot area of 38,333 square feet instead of the required 60,000 square feet for a two family dwelling.  The existing dwelling has been used as a two family dwelling since 1985.  The property is located in the General Residence and Farming District as shown on Map 25, Lot 14.  The applicable sections of the zoning bylaw are Section 4.4 (3) Table of Uses, and Section 5.2.1 Table of Dimensional and Density Requirements.
Following the Public Hearing, the Board denied the request to grant a Special Permit to Michele Tibbetts for the designation of an existing dwelling as a two family dwelling and to deny the request for a Variance to allow the existing lot frontage of 110 feet, instead of the required 200 feet for a two family dwelling, and allow the existing lot area of 38,333 square feet instead of the required 60,000 square feet for a two family dwelling.  The Board made its finding based on the fact that all of the permitting paperwork has designated the house as a one family and that the owner has not shown financial hardship in making the request to convert the house to a legal two family.  The Board felt that the conversion of this building to a two family residential dwelling would be more detrimental to the neighborhood due to the undersized lot, the lack of required frontage, and the potential of there being rental units in a residential neighborhood.   A unanimous vote to deny the Special Permit and Variance was taken of the following members:  William Lucini, James Henderson, Armen Amerigian, Thomas Snell, and Fred Hartblay.
